The petitioner is apprehending his arrest in connection with Sisai P.S. Case No.126/2025, registered for the offence under Sections 303(2), 317(5), 3(5) of the Bharatiya Nyaya Sanhita, 2023, Section 4/21 of Mines and Minerals (Development and Regulation) Act, 1957, Rule 4/54 of Jharkhand Minor Minerals Concession Rules, 2004 and Rule 7/9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the Court of the learned Sub Divisional Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that false allegations are made against the petitioner of storing 15,900 cft. sand on a particular place. He further submits that the sand was not stored by the petitioner and that allegation is also there against 5 persons and one of the co-accused has been granted anticipatory bail in A.B.A. No.75 of 2026. He also submits that the petitioner is having one criminal antecedent of same nature. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there and even the petitioner is having one ( 2026:JHHC:2001 ) -2- A.B.A. No. 362 of 2026 criminal antecedent. 5. Considering that one of the co-accused has been granted anticipatory bail in A.B.A. No.75 of 2026 and the name of the petitioner has come only on suspicion and the person, who has taken name of the petitioner, his name is not disclosed in the FIR and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gumla in connection with Sisai P.S.
