GP FOR HOME 2 The Court made the following ORDER: The Writ Petition has been filed for the following relief: “…to issue Writ, Order or Direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the respondents more particularly Respondent No. 3, in frequently calling the petitioner to the Police Station without registering any criminal cases and threatening the petitioner to sign on empty bond papers to admit about the theft of Gold ornaments by his brother as illegal, arbitrary, unconstitutional, and without jurisdiction, without any authority of law and in violation to the settled principles. And consequently direct the Respondents not to call the petitioner to the Police Station without registration of any crime and pass…” 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader. 3. Mr. Eluru Sesha Mahesh Babu, learned counsel for the petitioner, submits that the petitioner has been called to the police station and threatened to sign on the empty bond papers and committed theft of gold ornaments. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that one Somisetty Venkata Subbarao lodged a complaint against the petitioner and some others, which was registered as a case in Cr. No. 20 of 2026 of Eluru I Town Police Station for the alleged offences punishable under Sections 318(4) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, “the BNS”)1. For the purpose of conducting a preliminary enquiry in the said crime, the petitioner was called to the police station. The police have not compelled 1 The BNS 3 the petitioner to sign on any blank papers and have not acted in any illegal manner against the petitioner. 5. Having regard to the entire facts and circumstances of the case, and recording the submissions made by the learned Assistant Government Pleader, the Writ Petition is disposed of, directing respondent Nos. 3 and 4 to follow the procedure as contemplated under the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 2. The petitioner shall cooperate with the Investigating Officer in accordance with law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
