(2) According to petitioner, he appeared in Second Professional Examination of BAMS Course from Rishikul Govt. Ayurvedic College, Haridwar in 2011, but he was declared unsuccessful; he was permitted to appear in Third Professional Examination in 2013, in which also he was declared unsuccessful. By means of this writ petition, petitioner has sought a direction to the University to supply copy of answer scripts to him, as he apprehends that his answer scripts were not correctly evaluated. (3) Learned Counsel for the University was granted time to get instructions. Today, on instructions, he submits that answer scripts for the university examinations, held in Academic Session 2010-11, were weeded out after issuing a public notice, which was published in newspapers, including UKHC010122582026 2026:UHC:6728 Dehradun Edition of Hindi Daily ‘Amar Ujala’ on 14.2.2012. Learned Counsel for the University submits that as per the University Policy, answer scripts are destroyed after one year of holding the examinations and thus there is inordinate delay in filing the writ petition. (4) This Court finds substance in the submission made by learned Counsel for the University. Since the answer scripts have been destroyed after informing all concerned, therefore, the relief as claimed in the writ petition cannot be granted at this belated stage. Writ petition is, accordingly, dismissed. (5) As regards the prayer made by learned Counsel for the petitioner that petitioner be permitted to reappear in the examination, this Court cannot direct the University Authorities to grant such permission. However, it would be open for the petitioner to make representation seeking permission to reappear in the examination and if such representation is made, Registrar of the University shall take decision on the same, as per law.
