1. The present anticipatory bail application has been filed by the accused-petitioner under Section 482 BNSS (corresponds to Section 438 Cr.P.C) in connection with F.I.R. No.01/2025 registered at Cyber Police Station (Baran), District-Baran for the offence(s) punishable under Section(s) 316(3), 318(4) & 319(2) of BNS and Section 66-D of Information Technology (Amendment) Act, 2008.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case as they have nothing to do with the alleged offences. He further submits that the alleged offences are triable by Magistrate and has no criminal antecedent.

Learned counsel also submits that the petitioner and complainant have amicably entered into a compromise dated 12.04.2026.

Learned counsel for the petitioner also submits that the co- accused Shivani Yadav has already been granted the benefit of anticipatory bail by the co-ordinate bench of this Court on 01.05.2026 in SB Criminal Misc. Bail Application No.6725/2026. Hence, the petitioner may be given the benefit of anticipatory bail.

Learned counsel for the complainant admits the fact of having entered into compromise with the petitioner. He further submits that the complainant has no objection if the petitioner is given the benefit of the anticipatory bail.
4. Learned Public Prosecutor opposes the submissions made by
learned counsel for the petitioner hereinabove.

Taking into consideration the overall facts and circumstances of the case; the arguments advanced by the learned counsel for the petitioner, the fact that the case is triable by a Magistrate, and parties have already entered into compromise but without commenting anything upon the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on anticipatory bail.

Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of accused-petitioner namely, Sunny Prajapat S/o Narendra Prajapat and Ujjawal Lalawat S/o Chandraparkash in Connection with FIR No. 01/2025 registered at Cyber Police Station (Baran), District Baran, shall not be arrested, provided they furnish personal bond in the sum of Rs. 50,000/- with two sureties in the sum of Rs. 25,000/- each to the satisfaction of the
[2026:RJ-JP:23400] (3 of 3) [CRLMB-9460/2026] SHO/IO/Arresting Officer of the concerned police Station on the following conditions:- (i) The accused-petitioner shall make herself available for interrogation by a police officer as and when required; (ii) The accused-petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or any police officer; (iii) That the petitioner shall not leave India without previous permission of the Court.
