The present writ petition has been filed for the following reliefs :- “(a) for issuance of an appropriate writ/writs, order/orders, direction/directions or a writ particular in nature of mandamus commanding upon the respondents to immediately and forthwith remove the boundary wall of the Tirla Panchayat Building taking into the consideration that the same has been built encroaching the part area of the land appertaining to Khata No.1, Plot No.3052, 3482 Area about 9.44 decimal and 0.57 decimal respectively as - 1 - W.P.(C) No.496 of 2026 2026:JHHC:2881 well as the area of Khata No.87, Plot No.3488, Area 1.51 decimal from which the original survey road passes. Encroached parts of the plots Khata No.1, Plot 3052,9.44 decimal and Khata no. no.1. Plot No.3482 area 0.57 decimal, which belong to the petitioner as a bakast/rayati Land situated at village- Tirla, P.O. Bagodar, P.S.-Bagodar, District- Giridih taking into the consideration that respondent no.7 has forcefully constructed the said boundary wall of Tirla Panchayat Bhawan in Feb-March 2024 despite protest letter to CO, Bagodar on 18th January 24 and a Pitch road constructed forcibly by Mukhiya and her antisocial group on 03/06/2025 in the presence of CO, Bagodar and ASI, Bagodar PS through the rayati land of description given hereinabove despite the protest of apprehended forcibly pukka (pitch) road construction was made to CO, Bagodar, SDO, Bagodar- Suriya, PS-Bagodar and others on 12/09/2024, 21/01/2025 and 08/03/2025 which is absolutely wrong, illegal, arbitrary, malafide and bad in law as well as in fact. (b) for further issuance of an appropriate writ/ writs, order/ orders, direction/ directions upon the respondents to immediately and forthwith restrain the public of the Tirla Panchayat from convening annual fair on the land comprising under Khata No.1, Plot No.3052, area 2.24 acre belong to the petitioner as bakast/rayati land taking into the consideration that the land measuring area 12 (twelve) decimals from the plot no.3052 has been donated to the State Government for building School over the same in 1991vide deed no.3647/1991. (c) for issuance of an appropriate writ/ writs, order/ orders, direction/ directions or a writ particular in nature of mandamus commanding upon the respondents to immediately and forthwith provide security/police protection to the petitioner to - 2 - W.P.(C) No.496 of 2026 2026:JHHC:2881 get boundary wall constructed around his Bakast Rayati land appertaining to Khata No. 01, Plot No. 3052, Area about 2.1 Acre situated at village -Tirla, P.O.-Bagodar, P.S.- Bagodar, District- Giridih, taking into the consideration that some antisocial/ disturbing and unlawful elements namely (1) Sri Shiv Narayan Mahto, S/o-Late Bishun Mahto, (2) Bhikhan Mahto, Son of Late Doman Mahto, (3) Rajendra Mahto, S/o-Late Gopal Mahto, (4) Arjun Swarnarkar and others in connivance with Mukhiya (Respondent No.7) restraining and prohibiting the petitioner from getting constructed said boundary wall around piece of land of description there hereinabove, which is absolutely illegal, bad, and amounting to causing irreparable loss and injury to the petitioner.” 2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to work out his remedy in accordance with law. 3. Learned counsel for the State has raised no objection. 4. With the aforesaid liberty, the present writ petition is, hereby, disposed of. 5.
