Welfare Officer, Narasipatnam, Visakhapatnam District is highly illegal, unjust, arbitrary, void and in violatioa of Article 14, 15 and 21 of the Constitution of India and consequently set aside the Impugned Proceedings in Procgs.No. E/1488/2018, dated 21.08.2019 issued by the 3rd respondent, continue the services of the petitioner as Assistant B.C. Welfare Officer, Narasipatnam, Visakhapatnam District and pass IA NO: 1 OF 2019 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to Suspend the 2nd respondent proceedings dated 17-07-2019 in Memo.No.869/Vig./D1/2018 by continue us as Hostel Welfare Officers in our respective places pending disposal of the Writ Petition and pass Counsel for the Petitioner: 1. GP FOR SOCIAL WELFARE (AP) The Court made the following: 3 VS,J W.P.No.12557 of 2019 ORDER: This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “…to issue a writ in the nature of a writ of mandamus or any other appropriate writ, direction, order or orders declaring the action of the 3rd respondent in issuing the Impugned Proceedings in Procgs.No. E/1488/2018, dated 21.08.2019 suspending me from services as Assistant B.C. Welfare Officer, Narasipatnam, Visakhapatnam District is highly illegal, unjust, arbitrary, void and in violatioa of Article 14, 15 and 21 of the Constitution of India and consequently set aside the Impugned Proceedings in Procgs.No. E/1488/2018, dated 21.08.2019 issued by the 3rd respondent, continue the services of the petitioner as Assistant B.C. Welfare Officer, Narasipatnam, Visakhapatnam District and pass…” 2. The brief facts of the case are that while the petitioner was working as B.C. Welfare Officer at Narasipatnam, Visakhapatnam district, basing on a complaint made by some unknown persons, the 3rd respondent vide proceedings dated 09.07.2018, suspended the petitioner. Thereafter, vide notice dated 20.08.2018 issued by the 4th respondent, the petitioner was directed to appear before the 5th respondent for enquiry. The 5th respondent, after conducting a detailed enquiry, submitted a report on 27.11.2018, relying on which, the 3rd respondent issued the impugned proceedings dated 21.08.2019 suspending the petitioner pending 4 VS,J W.P.No.12557 of 2019 disciplinary proceedings. Aggrieved by the same, the present writ petition is filed. 3. When the writ petition came up for hearing on 26.09.2019, this Court passed the following interim order: “…There shall be interim suspension of the order, dated 21.08.2019, issued by the 3rd respondent until further orders.” 4. Heard Ms. M. Sandhya Rani, learned counsel representing Mr. M. Krishna Rao, learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare. 5. Perused the entire material available on record. Today when the writ petition came up for hearing, learned Assistant Government Pleader furnished a copy of letter addressed by the District B.C., Welfare and EO (I/C), Visakhapatnam to the 3rd respondent vide Rc.No.A1/151/2019/BCW, dated 19.08.2026 wherein it is stated that pursuant to the interim orders passed by this Court, the 3rd respondent, vide proceedings dated 10.10.2019 revoked the suspension orders of the petitioner subject to finalization of the disciplinary action pending against the petitioner and reinstated the petitioner; that the petitioner was posted as Assistant B.C., Welfare Officer, Narasipatnam. It is further stated that the petitioner got retired as Assistant B.C., Welfare Officer, Chodavaram on 30.06.2025 upon attaining the age of superannuation. 5 VS,J W.P.No.12557 of 2019 6. In view of the fact that the suspension orders of the petitioner were revoked vide proceedings dated 10.10.2019 and as the petitioner retired from service upon attaining the age of superannuation on 30.06.2025, this Court is of the opinion that no further orders are necessary in the present writ petition. 7. Accordingly, this writ petition is closed. There shall be no order as to costs.
