JUSTICE MRIDUL KUMAR KALITA O R D E R 07.07.2026 Heard the learned counsel Mr. S.C. Biswas appearing for the petitioner. Also heard Mr. K. Baishya, the learned Addl. Public Prosecutor, Assam. 2. This application under Section 482 of the BNSS, 2023 has been filed by the petitioner, namely- Bappan Dhar @ Bapan Dhar in connection with P.R. Case No.2633/2024 (corresponding to Katigorah P.S. Case No.52/2024, under Sections Page No.# 2/2 307/325/326 read with Section 34 of the Indian Penal Code) pending before the court of learned Judicial Magistrate First Class No.2, Cachar, Silchar. 3. The learned counsel for the petitioner has submitted that in the aforesaid case, charge sheet has been laid against the present petitioner under the aforementioned penal provisions. He submits that initially summonses were issued against the petitioner by the trial court. However, in spite of receiving summonses, he could not appear before the trial court due to some personal difficulties. He submits that in the meanwhile Non-Bailable Warrant of Arrest (N.B.W.A.) was issued against him and the next date of his appearance has been fixed on 12.08.2026. 4. The learned counsel for the petitioner submits that the petitioner is ready to face the trial. However, since N.B.W.A. has been issued against the petitioner, he apprehends that he may be arrested at any time in connection with the aforesaid case. 5. Considered the submissions made by the learned counsel for both sides. 6. Since, the present petitioner, namely- Bappan Dhar @ Bapan Dhar is willing to face the trial and since co-accused, namely- Prabhat Dey and Pradyut Dey are on bail, he (the present petitioner) is directed to appear before the trial court on the next fixed date i.e. 12.08.2026. To facilitate his appearance before the trial court on next fixed date, N.B.W.A. issued against the petitioner shall not be executed. On his appearance before the trial court, the petitioner may pray for a regular bail before the said court. With the above observation, the instant anticipatory bail application is disposed of.
