The State of West Bengal Mr. Arunava Ganguly …for the Petitioner This is an application wherein the petitioner has prayed for a direction upon the court below for expeditious disposal of the S.T case no. 6(08) of 2017, presently pending before the learned Additional Sessions Judge, 1st Court, Barasat. Being aggrieved by the abnormal delay caused in disposing the cases, learned counsel for the petitioner submits that in this case, the complaint was lodged on 3rd June, 2014 and the charge-sheet was submitted on 9th May, 2015 and the charge was framed on 22nd August, 2017. The prosecution proposed to examine 30 witnesses out of which only examinations of PW1 and PW2 have been completed. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the State/opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party/State is hereby dispensed with. In view of the aforesaid facts and circumstances of this case and that the prayer made by the petitioner is justified, the instant application being CRR 5552 of 2025 is hereby disposed 2 of with a direction upon the court below to make every endeavour for expeditious disposal of the abovementioned S.T case no. 6(08) of 2017 and to make his best effort to conclude the trial preferably within a period of one year from the next date of hearing.
