PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 483(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to modify/relax the condition in Point No.6 (iii) imposed in the Order dated 20.01.2026 in Crl.M.P.No.1705 of 2025 in Crime No.583 of 2025 of P.M. 2 Palem Police Station, Visakhapatnam, by permitting the petitioner/Accused No.4 to travel to and reside in the Saudi Arabia for the purpose of employment with Tata Consultancy Services (TCS). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. Learned counsel for the petitioner submits that the petitioner has been working as a Software Employee. Earlier, he was sent on a project work to Netherlands. He submits that the petitioner has got a promising career to work overseas. The condition imposed by the learned Sessions Judge in the Order dated 20.01.2026 at paragraph 6(iii) would obstruct the career progression of the petitioner as a Software Employee. Hence, it is urged to relax the condition. 4. It is not that that the petitioner from the very beginning was working in overseas. He was sent on some project work to Netherlands. Severe allegations are levelled against the petitioner, including the offence under the provisions of Banning of Unregulated Deposit Schemes Act, 2019. Therefore, the petitioner is at liberty to approach the learned Sessions Judge as and when he gets an opportunity to work abroad. If such opportunity comes to the petitioner, the learned trial Court, upon being satisfied with the material placed before it, may pass appropriate orders including securing the petitioner before the learned trial Court for trial. 3 5.
