BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER Date : 19-02-2026 Heard Mr. R. Amin, learned counsel appearing for the accused applicant and Mr. R. J. Boruah, learned Additional Public Prosecutor for the State. 2. This is an application under Section 482 of the BNSS, 2023 praying for granting pre-arrest bail to the accused applicants in connection with Fakirgonj P.S. Case No. 84/2025, corresponding to G.R. Case no. 1190/2025, under
Page No.# 2/3 Sections 49/103(1) of BNS, 2023. 3. The allegation in the FIR, dated 09.08.2025, is that the accused applicant, along with her husband, tortured her mother-in-law. Due to the injuries sustained by the mother-in-law, she subsequently succumbed to them. 4. On receipt of the FIR, the police registered Fakirgonj P.S. Case No. 84/2025 under the aforementioned Sections. After completion of the investigation, the charge-sheet, being Charge-sheet No. 108/2025 dated 29.11.2025, was submitted, wherein the accused applicant has been shown as an absconder. 5. Mr. Amin, learned counsel for the accused applicant, submits that the husband of the accused applicant, who has also been named in the FIR as well as in the charge-sheet, has already been granted bail by the Judicial Magistrate First Class, Dhubri, on 10.11.2025. Learned counsel further submits that the accused applicant, being a lady having a child, is willing to cooperate with the trial therefore, she should be granted interim protection at this stage. 6. Mr. R. J. Boruah, learned Additional Public Prosecutor for the State, on the other hand, submits that there is incriminating material against the accused applicant and since the charge-sheet has already been filed, this Court should reject the interim prayer of the accused applicant. 7. This Court has considered the submissions made by the learned counsel appearing for the respective parties and perused the Case Diary which has been produced by the learned Additional Public Prosecutor. 8.
Taking into account the facts that the accused applicant is a lady with a child; that her husband, who has been named in the FIR and charge-sheet, has already been granted bail by the learned Trial Court and that the accused
Page No.# 3/3 applicant is willing to cooperate with the trial, this Court is of the considered opinion that the accused applicant should be granted the privilege of pre-arrest bail at this stage. Accordingly, it is directed that, in the event of the arrest of the accused applicant in connection with Fakirgonj P.S. Case No. 84/2025, corresponding to G.R. Case No. 1190/2025, she shall be released on bail upon furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand) with one surety of like amount to the satisfaction of the learned Judicial Magistrate First Class, Dhubri, Assam, subject to the following conditions: i. The accused applicant shall appear before the learned Trial Court on the next date fixed, i.e., 22.04.2026; ii. The accused applicant shall cooperate with the trial and appear before the Trial Court as and when called for; iii. The accused applicant shall not attempt to hamper or tamper with evidence or influence the witnesses. 9. With the above directions, the anticipatory bail application stands disposed of. 10.
