1. Heard learned counsel for the parties.
2. The present writ petition has been filed for the following reliefs :-
“(a) for issuance of appropriate writ(s), Order(s), direction(s) in nature of the mandamus commanding and directing upon the concerned Respondents authorities to show as to why and under what circumstances the Respondents have appointed Respondent No.-5, as Pump Khalasi, in Rajmaal - 1 - W.P.(C) No.1070 of 2023
2026:JHHC:636 Project, EC.L., Lalmatia, on the basis of the compensation of land, acquired by the E.C.L Project for mining works, situated as Jamabandi No-15 of Mauza Lalmatia, covering a total area of 2 Acres 11 Decimals and 9 Dhurs, whereas the petitioner was the heir of the recorded tenant of the aforementioned land, and the Respondent no.-5 has got his job in E.C.L., Lalmatia fraudulently in compensation of the affirmation land acquired by the Respondents authorities. (b) further prays for a writ(s)/ order(s)/ direction(s) commanding and directing upon the Respondents authorities to remove the Respondent NO.-5 from his service of Pump Khalasi, in Rajmahal Project, E.C.L, Lalmatia.”
3. It appears that the land, in question, has been acquired in the year 1985 and the job has also been granted to the private respondent No.5 in the year 1985. Now, the claim has been made that the said employment is wrong and further, the petitioner is the real awardee.
4. Such dispute can only be resolved by the competent civil court and not by the writ Court, as it requires of taking evidence. The matter has also become stale by efflux of time.
5. In that view of the matter, the present writ petition is, hereby, disposed of giving liberty to the parties to work out their remedy in accordance with law.
6. Pending interlocutory application, if any, stands
disposed of.
