(2) Petitioner applied for allotment of fair price shop, however fair price shop in question was allotted in favour of respondent no. 4. Thus feeling aggrieved, petitioner has approached this Court seeking the following reliefs:
“A. issue a writ, order or direction in the nature of certiorari quashing the
order of allotment dated 12.06.2026, passed by Respondent No. 2, marked as Annexure No. 1 (Page No. 14-16) to the present writ petition, whereby the Fair Price Shop in Village Basai, Tehsil Ramnagar, District Nainital has been allotted in favour of respondent no. 4;
B. issue a writ, order or direction in the nature of mandamus commanding and directing the Respondent Authorities to consider and decide the Petitioner’s claim for allotment of the Fair Price Shop in Village Basai, Tehsil Ramanagar, District Nainital, in pursuance of the resolution dated 25.11.2024, afresh and in accordance with law, uninfluenced by the objection under Clause 5 of the Government Order

2026:UHC:6671 dated 15.10.2005, within a time-bound period as this Hon’ble Court may deem fit; Annexure No. 2 P. No. 17-21 and Annexure No. 7, P. No. 31-44 to this writ petition.”
(3) Learned State Counsel submits that if petitioner has any grievance, then he could have approached the District Magistrate, by making a representation, who can look into the issues raised by petitioner.

Learned Counsel for the petitioner submits that writ petition may be disposed of by directing the District Magistrate to consider petitioner’s representation.
(5) Writ petition is, accordingly,
disposed of with liberty to petitioner to make representation. If he makes representation within ten days from today, District Magistrate concerned shall take decision in the matter, as per law, within six weeks thereafter. It goes without saying that respondent no. 4 shall also be given reasonable opportunity of hearing, while taking any decision in the matter.
