IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2212 of 2026 Rabi @ Baikuntha Rana …. Petitioner Mr. B. Karna, Advocate -Versus- State of Odisha …. Opposite Party Mrs. S. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 22.04.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Uditnagar P.S. Case No.104 of 2025 corresponding to Special G.R. Case No.17 of 2025 pending in the court of learned Additional Sessions Judge-cum-Special Judge, Rourkela on the grounds stated. 3. Perused the FIR as at Annexure-1. It is submitted that the co-accused, namely, Sanjib Bhesara is on bail pursuant to the Court’s order in BALPL No.9042 of 2025 as at Annexure-2 series. The submission of learned counsel for the petitioner is that the present accused is not involved rather recovery and seizure of the contraband Ganja has been made from the co- accused named above and since in the meantime, the chargesheet is already filed, the petitioner should be allowed to go on bail with conditions which is objected by Mrs. Mohanty, learned ASC for the State. From the FIR at Annexure-1, the Court finds that there has been seizure of 21 Kg 220 Grams of Ganja not from the petitioner but from the co-accused, who is already on bail as earlier stated. On being asked, it is informed to the Court by learned counsel for the petitioner that the accused is having no similar antecedent. Considering the above facts and submissions of learned counsel for the respective parties and as there has been closure of investigation in the meantime, the Court is though not inclined to entertain the plea of pre-arrest bail but is of the view that the petitioner should be directed to surrender before the learned court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned Additional Sessions Judge-cum-Special Judge, Rourkela in connection with Uditnagar P.S. Case No.104 of 2025 corresponding to Special G.R. Case No.17 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
