Sandhawalia , Chief Justice ( O ral) The present applications have been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (for short ‘the Act’) for appointment of an Arbitrator. 2. The dispute as such pertains to the work of extraction, carriage and transportation of resin, as per the allotment. 2 3. The necessary notice(s), dated 29.07.2023 (Annexure P-3) was sent to the respondents on 29.07.2024 as per Clause 36 of the Agreement Deed for the appointment of the Arbitrator, raising a claim of Rs.1,16,400/- in Arbitration Case No. 49 of 2025 and a sum of Rs.80,340/- in Arbitration Case No. 55 of 2025. No response to the said legal notice was filed in both the cases. 4. The stand taken of the respondent- Corporation in the reply is that the recovery has been made in accordance with Clause 24 of the Agreement Deed duly signed by both the parties. There was no denial regarding the Arbitration Clause as such by the respondents. 5. Learned Counsel for the petitioners submits that the dispute is between the same parties in these cases and in Arbitration Cases No. 47, 48 & 50 of 2025 and Mr. B.M. Chauhan, Senior Advocate of this Court, was appointed as an Arbitrator as per 3 the order dated 12.12.2025 in Arbitration Cases No. 47, 48 & 50 of 2025. 6. Keeping in view the quantum as such and the dispute of similar nature, we deem it fit to allow theses applications and appoint Mr. B.M. Chauhan, Senior Advocate of this Court, as an Arbitrator (Mobile No.9816024600) to adjudicate the dispute between the parties. After his disclosure in writing is obtained in terms of Section 11(8) of the Act and only after receipt thereof, his appointment, as an Arbitrator, shall come into force. 7. On his giving consent to arbitrate the dispute between the parties as an Arbitrator, Mr. B.M. Chauhan, Senior Advocate, shall enter into reference, and shall pass an award in accordance with law. 8. Copy of this order be furnished to the learned Counsel for the parties and also to the learned Arbitrator. The learned Arbitrator so appointed, shall be entitled to fee as per stipulation 4 contained in 4th Schedule appended to the Arbitration and Conciliation Act, 1996. 9.
