SATAPATHY Order No. ORDER(ORAL) 05.05.2026 02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Mahanga PS Case No. 67 of 2026 corresponding to GR case No. 98 of 2026 pending in the file of learned Addl. Sessions Judge, Salipur for commission of offences punishable U/Ss. 331(4)/305(a)/317(2) of the BNS, on the main allegation of committing theft by trespassing into the house of the informant. 4. Heard, Mr. Ranjit Mohanty, learned counsel for the petitioner in BLAPL No. 3316 of 2026; Mr. Bibhuti Ranjan Mohanty, learned counsel for the Petitioner in BLAPL No. 3911 of 2026 and Mr. C. Mahanty, learned p. 2 Additional Public Prosecutor in the matter and perused the record. 5. After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the petitioners vis-a-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody with submission of charge sheet in the meantime and taking into account the recovery part of the stolen articles together with the gold ornaments and the Petitioners being not named in the FIR and taking into account the mode and manner of implication of each of the Petitioners in this case and the offences alleged against the Petitioner being triable by Magistrate and keeping in view the law laid down by the Apex Court in Satender Kumar Antil Vrs. Central Bureau of Investigation; (2022) 10 SCC 51 and the grant of bail to co-accused Padmalav Sahoo @ Padmanav Sahoo by a coordinate Bench of this Court in BLAPL No. 5307 of 2025, this Court without expressing any view on merit admits the petitioners to bail. 6. Hence, these two bail applications of the petitioners namely Mahendra Kumar Sahoo & Sajan Das @ Bikram Das in BLAPL Nos. 3316 and 3911 of 2026 are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- p. 3 (i) the petitioner-Sajan Das @ Bikram Das shall report attendance before the jurisdictional Police Station once in a fortnight preferably on 2nd Sunday in each month in between 10 A.M. to 12 Noon for six(06) months from the actual date of release from the custody. The I.I.C. of Jurisdictional Police Station shall not detain the petitioner-Sajan Das @ Bikram Das unnecessarily after recording his attendance beyond the time as stipulated. 7. Accordingly, these BLAPL Nos. 3316 and 3911 of 2026 stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
