Heard learned counsel for the parties. 2. The instant writ application has been preferred by the petitioner praying therein for the following relief: For issuance of an appropriate writ in the nature of certiorari for setting aside the Order dated 16.04.2019 vide notification No. JH/RO/RNC/Vig./JH/232/EDLI/19/21/1982 (Annexure-1) whereby and whereunder the show cause has been issued to the Petitioner that as to why the disciplinary proceedings under Rule 10 of EPE (CC & A) Rules 1971 should not be recommended against him in a most arbitrary, illegal and malafide manner for a cause of action which has occurred as back as 17 years prior to issuance of the show cause and without any explained delay and also without furnishing the relevant documents for establishing the allegations against the Petitioner. 3. It appears that the petitioner has challenged the order dated 16.04.2019 whereby a show cause was issued to the petitioner as to why the disciplinary proceeding be not recommended against him as the cause of action has occurred 17 2026:JHHC:878 2 years prior from issuance of show cause. A supplementary counter affidavit has been filed wherein at para 5 the delay has been explained. 4. Even otherwise, there is no stay in this case and the disciplinary proceeding is going on, as such, no relief can be granted to this petitioner. 5.
