For Petitioner(s): Mr.S.Thirumurugan For Respondent(s): Mr.P.Dhileepan, Government Advocate (Crl.Side) ORDER The petitioner, who apprehends arrest for the alleged offence under Sections 316(5), 318(4), 61(2) of the Bharatiya Nyaya Sanhita, 2023, Section 5 of the TNPID Act, and Sections 21(2), 21(3), 23 and 25 of BUDS Act, in Crime No.10 of 2025, on the file of the respondent police seeks anticipatory bail. https://www.mhc.tn.gov.in/judis CRL.OP.No.7931 of 2026 __________ Page2 of 8 2. The allegation against the petitioner is that the defacto complainant was induced to invest in an online investment platform which projected itself as an intermediary facilitating invoice discounting transaction between vendors of reputed corporate entities and prospective investors. It is alleged that the said platform was aggressively promoted through various social media platforms such as facebook, instagram and you tube assuring lucrative and fixed returns ranging between 15% and 22% per annum. Believing such representation, the complainant is stated to have invested a total sum of Rs.75,00,000/-, comprising Rs.55,00,000/- in his own name and Rs.20,00,000/- in the name of his spouse through banking channels, including NEFT and RTGS in to the said accounts of the said company. The amounts so collected were diverted and misappropriated through various bank accounts by way of layered transactions, resulting in wrongful loss to the defacto complainant and other investors. Hence, the case has been registered. 3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that according to the First Information Report, the defacto complainant came to know about the existence of the online platform during 2023 whereas the petitioner joined in the company only on 20.01.2025 and that immediately within a period of 15 days he send the resignation on 06.02.2025. He would also https://www.mhc.tn.gov.in/judis CRL.OP.No.7931 of 2026 __________ Page3 of 8 submit that as against the petitioner on the very same set of facts there are 8 cases in the States of West Bengal, Bangalore City, Delhi, Rajasthan, Maharshtra, Thane West and Maharshtra. He would also submit that since the there are various cases pending in various State. The co-accused had filed an application before the Hon’ble Supreme Court seeking relief for clubbing of all the FIRs wherein the Hon’ble Supreme Court has granted the relief in WP(Crl.)Diary.No.26673/2025 dated 26.09.2025. 4. At this juncture, the learned counsel for the petitioner would submit that the Hon’ble Supreme Court in para-14 of the order has directed not to harass the petitioner and others against whom warrants are pending. Hence, he prays to grant anticipatory bail to the petitioner. 5. The contention was not seriously disputed by the learned Government Advocate (Crl.Side) appearing for the respondent police, though would submit that the petitioner has got 8 previous cases. He would fairly admit that those cases are also on the similar set of facts and he also fairly concedes that the co- accused filed an application before the Hon’ble Supreme Court for clubbing of all the FIRs. However, considering the gravity of the allegations namely, involvement of 37 crores and the sufferings of 122 victims, he opposed to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis CRL.OP.No.7931 of 2026 __________ Page4 of 8 6. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record. 7. Though there was allegations and counter allegations, the fact remains that the co-accused has already moved an application before the Hon’ble Supreme Court in Writ Petition (Criminal) No.26673 of 2025 for clubbing of FIR wherein in para-14 the Hon’ble Supreme Court has ordered as follows: “14. We notice that some of the petitioners are under arrest and are languishing in jail. Considering the fact that they have spent months together in jail, they shall be released on bail on such conditions imposed by the jurisdictional Magistrate, including that of cooperation in the investigation. Others against whom warrants are pending shall not be arrested. The above order shall be continued for a period of six months. Within the six-month period the petitioners shall appear before the Jurisdictional Courts in which the various FIRs are registered praying for regular bail, which shall be considered on the same day and granted on conditions found appropriate including the condition of cooperating with the investigation.” 8. It is an admitted fact that the allegations referred to in other FIRs, namely, Teleungana, Maharshtra and West Bengal, are on very same set of facts. In view of the such factual position, and that the Hon’ble Supreme Court has already directed the authorities not to harass against whom warrants are https://www.mhc.tn.gov.in/judis CRL.OP.No.7931 of 2026 __________ Page5 of 8 pending, this Court forms a view that the petitioner also to be given parity as per the direction given by the Hon’ble Supreme Court. Hence, this Court is inclined to enlarge him on anticipatory bail, subject to certain conditions. 9. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy is made ready, before the learned TNPID Court, Chennai, on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a) If the petitioner fails to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; (b) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity; (c) The petitioner shall report before the respondent Police at 10.30 a.m., for a period of two months and he is also directed to surrender his Passport before the respondent police; (d) On breach of any of the aforesaid conditions, the https://www.mhc.tn.gov.in/judis CRL.OP.No.7931 of 2026 __________ Page6 of 8 learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v.
