JUSTICE RAJESH MAZUMDAR ORDER 03.07.2026 Heard Mrs. H. Lalmalsawmi, learned counsel for the petitioner. Also heard Mr. J.C. Lalnunsanga, learned counsel for respondent Nos. 4-6 and Ms. Linda L. Fambawl, learned Addl. AG for respondent Nos. 1-3. 2. This matter had been listed yesterday i.e., 02.07.2026, when a submission had been made on behalf of the State that the appointment orders had been issued and the selected private respondents had also joined their respective post on 07.05.2026. 3. Today, the learned counsel for the petitioner has submitted that on the Page No.# 3/4 basis of additional affidavit filed today itself, that the respondent No. 8 had tendered his resignation from the post of the Junior Grade of Mizoram Planning, Economic & Statistical Service with effect from the date of the notification itself, and therefore the said post had now fallen vacant. 4. The learned counsel for the petitioner had submitted that since the petitioner is vying for one of the post, at this stage if the vacancy created by the resignation of the respondent No. 8 is allowed to be filled up by the respondent authorities by appointing any candidate in the panel list, the petitioner may suffer irreparable loss. 5. The copy of the additional affidavit has been served upon the counsel appearing for the State and also upon the learned counsel appearing for the MPSC. 6. We have heard the learned counsel for the parties. 7. In the interest of justice, it is provided that in the event the post which has fallen vacant upon the resignation of the respondent No. 8 from the post of Junior Grade of Mizoram Planning, Economic & Statistical Service has not been filled up till date, the same shall not filled up from any candidate of the panel list, without liberty from the Court.
