04/ 16.01.2026: Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Complaint Case No. 212/2024, registered under sections 26(1), (g), (d), (f), (h), 41, 42 and 52 of Indian Forrest Act, 1927 (Bihar Amendment Act, 1989) and under sections 27, 29, 31 and 51 Wild Life Protection Act and cognizance has been taken under section 26 of Indian Forest Act, 1927 (Bihar Amendment Act) 1989 and under section 51 of Wild Life Protection Act, pending in the Court of learned Chief Judicial Magistrate at Koderma.

Learned counsel for the petitioners submits that allegations are made of picking of mica scrap after excavating it illegally from the reserved forest area and it has been stated that from the unknown source the name of the petitioners has been surfaced. He next submits that petitioners have got no criminal antecedent which is disclosed in para 13 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that the name of the petitioners has come on the secret information.

Considering that the person who has taken the name of the petitioners, the name of that person is not disclosed in the complaint and further the petitioners have got no criminal antecedent which is disclosed in para 13 of the petition, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand)each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate at Koderma, in connection with Complaint Case No. 212/2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
