1. Heard learned counsels for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Baliapal P.S. Case No.24 of 2026 corresponding to C.T. Case No.96 of 2026 pending in the file of learned J.M.F.C., Basta on the grounds stated therein.
3. Perused the F.I.R. at Annexure-1. A case under Section 109 I.P.C. is registered. From the F.I.R. i.e. Annexure-1, the Court finds that the mischief was committed by a group of men and women causing large scale damage to the valuable items, the details of which are described therein. Recorded the
submissions of learned counsel for the respective parties. It is claimed that there has been a compromise between the parties in the meantime. In fact, the lessee of the sand quarry lodged the report alleging such mischief against the accused persons named in the F.I.R. Considering the above facts, this Court is not inclined to grant pre-arrest bail to any of the petitioners,
however, is of the view that all of them should surrender before the learned court below seeking a regular bail for considering the same on the plea of compromise and absence of any grievous injury caused to anyone as a result of the assault alleged therein.
4. Accordingly, it is ordered.
5. In the result, ABLAPL is disposed of. It is further
directed that in the event, the petitioners surrender within fortnight from today before the learned J.M.F.C., Basta in connection with Baliapal P.S. Case No.24 of 2026 corresponding to C.T. Case No.96 of 2026 and move an applications for regular bail, it shall be duly considered in the first hour and in case of rejection, they shall approach the Sessions Court during the second hour for orders on the same day. It is also directed that the plea of compromise between the parties and the claim of absence of grievous injury caused to anyone as a result of the incident shall be taken into account while dealing with the bail plea of the petitioners.
6. Issue urgent certified copy as per rules.
