The petitioner is seeking regular bail, in connection with Bhawnathpur P.S. Case No. 68/2025, registered under section 126(2), 115(2), 109 & 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa. 3. Learned counsel appearing for the petitioner submits that there are case and counter case between the parties and the petitioner's side has lodged Bhawnathpur PS Case No. 69 of 2025, which has been lodged by the mother of the petitioner, wherein serious allegation of molestation is also there. However, in the present case, allegation of molestation is not there against the petitioner. He next submits that the petitioner is in custody since 4.10.2025. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegation of assault is there. 5. Considering that there are case and counter case between the parties and the petitioner is in custody since 4.10.2025 and in the 2026:JHHC:991 2 case lodged by the petitioner, allegation is there of molestation. However, in the present case, molestation allegation is not there against the petitioner, I am inclined to grant regular bail. 6. Accordingly, the petitioner, named above, is directed to be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa, in connection with Bhawnathpur P.S.
