1. The grievance of the petitioner before this Court is that the petitioner has filed an application before the National Company Law Tribunal. On receipt of the said application on January 21, 2026, the Deputy Registrar, Scrutiny Section has sent a defect notice to the petitioner by directing the petitioner to cure the defects i.e., NJSP not attached with affidavit, vakalatnama not filed, proof of service not served upon the respondent mail id mentioned in basic details, requisite court fee stamp of Rs. 15/- not affixed in application and NCLT 3 not filed.

Learned counsel for the petitioner submits that the petitioner has submitted revised interlocutory application which was under scrutiny but subsequently, by an order dated March 3, 2023, the Registrar, NCLT has passed an
order by rejecting the application filed by the petitioner on the ground of defect as the petitioner could not cure the defect.
3. In the said impugned order dated March 3, 2023, it is categorically advised to the petitioner that if the
2 petitioner is aggrieved with the said order, the petitioner can prefer an appeal within 15 days as per the Rule 63 of the NCLT Rules, 2016. Instead of taking appropriate steps, the petitioner has filed the present writ application.
4. Considering the above, this Court finds that the writ application is not maintainable. Accordingly, the writ application is dismissed.
5. However, the dismissal of the writ application will not prevent the petitioner to take appropriate steps in terms of the NCLT Rules.
6. WPA 7307 of 2026 is dismissed.
7. However, there shall be not order as to costs.
8. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
