JUSTICE R.K. PATTANAIK Order No. ORDER 17.02.2026 02. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.1012 of 2025 pending in the file of learned Gram Nyayadhikari, Gram Nyayalaya, Puri arising out of Puri Sadar P.S. Case No.783 of 2025 on the grounds stated. 3. Gone through the FIR as at Annexure-1 and it reveals the circumstances leading to the alleged assault by the petitioner. The victims of the incident received injuries and were medically examined on police requisition. The copies of the medical examination reports of the injured are made available and the same are also perused. From the said reports, the Court finds all the injuries to be simple in nature. In fact, the injured received abrasions only. It submitted to the Court that the petitioner does not have any criminal antecedent and a first-time offender. Recorded the objection of the State. The submission is that the petitioner reacted to the excess committed by the informant when his sister was misbehaved. Having regard to the fact that injuries have been caused but simple in nature with the involvement of the petitioner, who is claim to have no antecedent, this Court considering the above claim is inclined to direct his release upon surrender before the learned court below instead of pre-arrest bail as has been demanded at present. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned Gram Nyayadhikari, Gram Nyayalaya, Puri within a fortnight from today, it is directed that he shall be released on bail in connection with G.R. Case No.1012 of 2025 corresponding to Puri Sadar P.S. Case No.783 of 2025 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper in the facts and circumstances. The above order shall not be given effect to, as is further directed, if in case, the learned court below finds the petitioner having antecedent of similar nature. 6.
