CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE NINALA JAYASURYA DATE : 27th April 2026 P C : Prayer in the writ appeal is for setting aside order dated 22.12.2025, passed by learned single Bench, whereby writ petition filed by present appellant/writ petitioner has been disposed of while granting liberty to writ petitioner to approach the competent civil Court for redressal of his grievance.
2. Appellant/writ petitioner filed W.P. No.35549 of 2025 with a grievance that respondent No.3 was not taking any action on petitioner’s representation, dated 11.11.2025, and respondent No.4 was being permitted to construct an

unauthorized structure and lay a water pipeline upon land, which is stated to be belonging to the appellant/writ petitioner.

Learned single Bench after considering the facts and circumstances specifically observed and referred to civil litigation pending between petitioner and private respondent and disposed of the writ petition while granting liberty to petitioner to approach the competent civil Court for redressal of his grievance. Aggrieved therefrom, this appeal has been filed.

Learned counsel for appellant vehemently argues that impugned order dated 22.12.2025, has been incorrectly passed without considering the controversy in its correct perspective.
5. We have heard learned counsel and have perused the record.
6. It is undeniable that a dispute regarding land in question is pending between appellant and private respondent. It is alleged by appellant that a forged settlement deed dated 27.05.2020, was executed and registered in favour of the son of private respondent. O.S. No.247 of 2021 stands filed by private respondent against petitioner and is admittedly pending adjudication.

Contention raised by learned counsel for petitioner that interference should be caused in exercise of jurisdiction under Article 226 of the Constitution of India as construction being raised is unauthorized, is devoid of any merit as this issue is clearly a disputed question of fact, which cannot be adjudicated in such proceedings. She is unable to point out any irregularity or

infirmity in the impugned order, dated 22.12.2025, whereby the writ petition filed by appellant has been disposed of while granting liberty to the writ petitioner to avail remedies in accordance with law while raising all available pleas. This writ appeal is, accordingly, dismissed with liberty as aforementioned. There is no expression of any opinion on merits of the matter. No costs.
Pending miscellaneous applications, if any, shall stand closed.
