1. Petitioner is plaintiff and has invoked the writ jurisdiction of this High Court under Article 227 of the Constitution of India seeking directions to the trial Court to decide his Civil Suit bearing No.21/2024 titled as Jaggo Vs. Jyoti Prakash, presently pending before the Additional District & Sessions Judge No.2, Bayana, District Bharatpur, expeditiously and within stipulated period as fixed by this Court.

2. Having heard counsel for petitioner and from the record, it appears that petitioner is a senior citizen aged about 76 years and filed civil suit to declare patta dated 18.02.2013 and sale deed dated 01.06.2023 as null and void qua his rights in respect an immovable property, which is stated to be in his possession and a consequential prayer of permanent injunction, not to dispossess him and not to interfere in his possession has also been made in the suit.
3. This Court finds that after filing of the suit, some objections in respect of improper valuation and payment of less Court fees arose, which have to be cured by the petitioner and now an amended plaint has been filed.
4. Taking into consideration facts and circumstances of the case, at this stage, this Court does not find any peculiar reason to issue any direction to take the present suit on precedence, marching over the other pending civil cases, however, considering the fact that petitioner is a senior citizen, It is hereby observed that the trial Court may proceed with the trial of the present suit in an expeditious manner but in accordance with law and no adjournments without any just cause shall be granted.
5. With aforesaid observations, instant writ petition stands
disposed of.
6. Stay application and other pending application(s), if any, stand disposed of.
7. A copy of this order be sent to the concerned trial Court.
