Petitioner has challenged the order dated 29.05.2026, whereby representation dated 29.11.2022 filed by the petitioner has been rejected. 2. Petitioner has prayer for a writ of mandamus commanding the respondents to pay the petitioner at par with the pay band of Pay Matrix Level – 06 (Pay-band 35,400 – 1,12,400 Grade Pay – 4200) since 27.07.2019. The salary which was received by the petitioner as Chief Assistant before his promotion to the post of Auditor also from ministerial cadre since 30.12.2017 and further to pay financial losses which have occurred to the petitioner due to late consideration for promotion to the post of Auditor by the respondents. 3. Learned counsel for the State raised a preliminary objection that the relief claimed by the petitioner can very well be granted by Uttarakhand Public Service Tribunal constituted under Uttar Pradesh Public Service (Tribunals) Act, 1976. 4.
