Mr. Narendra Bali, Advocate for the petitioners. Mr. Nikhil Bisht, Brief Holder for the State of Uttarakhand. 2. Petitioners have approached this Court seeking the following relief: “(a) Issue a writ order or direction in the nature of mandamus directing the respondent No.1 & 2 to provide adequate protection to the petitioners from respondents No.3 to 5 and other relatives of petitioner no.1, so that they may live peaceful marital life.” 3. Learned counsel for the petitioners would submit that petitioners were in a relationship with each other and they have solemnized their marriage on 21.04.2025 accordance with Hindu rites and rituals and they have registered their marriage under the provisions of Uniform Civil Code, Uttarakhand on 28.05.2025. It is submitted that respondent nos.3 to 6, who are family members and relatives of petitioner no.1, are opposed to the said marriage and has been extending threats to the petitioners. On account of such opposition, the petitioners apprehend danger to their life and personal liberty at UKHC010134642026 2026:UHC:6661 the hands of the private respondents. It is further submitted that both the petitioners have attained the age of majority. 4. Petitioner no.1 joined the proceedings through Video Conferencing, while, petitioner no.2 is present before this Court, who have been duly identified by their learned counsel. They state that they have voluntarily solemnized their marriage of their own free will, without any force, coercion or undue influence. 5. The documents on record reveal that both the petitioners are major. In that view of the matter, and in view of the ruling of the Hon’ble Supreme Court in the case of Lata Singh Vs State of U.P. and another, reported in (2006) 5 SCC 475, the petitioners have made out a case for grant of protection. 6. The Station House Officer, Police Station, Haridwar, District Haridwar is directed to assess the threat, if any, to the life and limb of the petitioners, and provide necessary protection, if it is found that there is a threat to the life and limb of the petitioners. The S.H.O. is further directed to summon the private respondents, and such other persons, who are inimically placed towards the marriage of the petitioners, and counsel them, in accordance with law. 7. The writ petition stands ordered accordingly.
