2 Also heard Ms. Vaishali Mahilong, learned Deputy Government Advocate for the respondent No.1 / State. 2. The petitioner has filed the present petition, praying for following relief:-
“It is, therefore, prayed that this Hon'ble Court may kindly be pleased to quash the First Information Report registered against the Petitioner vide Crime number 28/2024, registered by Police Station City Mahila Thana, Raipur, District Raipur, Chhattisgarh for offences under Sections 498-A, 406, 506 and 34 of the Indian Penal Code, along with Charge-sheet No. 22/2024 dated 30.03.2024 for offence under Section 498-A, 406 & 506 of the Indian Penal Code filed pursuant thereto, and the entire criminal proceedings arising therefrom, in the interest of justice.”

From perusal of the prayer and pleadings made in the present petition, it transpires that though cognizance has already been taken by the learned trial Court, the same has not been challenged in the present petition. 4. In view of the same, learned counsel for the petitioner pray to withdraw the present petition, with liberty to file afresh with appropriate prayer and pleadings. 5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh with appropriate prayer and pleadings, subject to depositing a sum of Rs.2,000/- as cost by the petitioners in the Registry of this Court and the same shall be transmitted to the Government SAA Gariyaband (C.G.) for wasting
