JUSTICE R.K. PATTANAIK Order No. ORDER 23.02.2026 01. 1. Heard learned counsels for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Nikirei P.S. Case No.0431 of 2025 corresponding to G.R. Case No.612 of 2025 pending in the file of learned J.M.F.C. (CT), Kendrapara on the grounds stated therein. 3. Perused the F.I.R. as at Annexure-1. A case has been registered for the alleged incident during which informant is said to have been assaulted by the petitioner. In course of hearing, Mr. Chandan Kumar Rout, learned counsel appears for the informant and files the Vakalatnama, which is taken on record and it is submitted by him that the matter has been compromised. Learned counsel for the petitioner submits that the informant has received injury, but he was treated and discharged on the same day. A copy of the OPD summary issued by Dr. Agarwal’s Eye Hospital is produced in support of the above claim. Considering the above facts and submissions p. 2 of the learned counsels for the respective parties, this Court though not inclined to grant pre-arrest bail to the petitioner, however, is of the view that he should surrender before the learned court below for being released with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned J.M.F.C. (CT), Kendrapara within a fortnight from today, the petitioner shall be released on bail in connection with Nikirei P.S. Case No.0431 of 2025 corresponding to G.R. Case No.612 of 2025 subject to him furnishing a bail bond of Rs.25,000/- (Rupees twenty-five thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6.
