This is an application filed under Section 482 of the BNSS, 2023, praying for grant of pre-arrest bail to the accused-applicant, namely, Ramjan Ali in connection with Serfanguri Police Station Case no. 02/2026, registered under Sections 318[4]/299/64/62/3[5] of the BNS, 2023. 3. The allegation, as narrated in the First Information Report [FIR] lodged by Page No. 2/3 one Sangita Lokbok before Serfanguri Police Station on 20.12.2025, inter alia, is that her son, Raju Rabha aged about 7 years could not walk for last 4/5 months and to cure her son, she was looking for a Traditional Healer [Kobiraj]; that on last 09.07.2024, one Shomser Ali came to her house and told her that he can arrange a good Kobiraj to cure her son; that accordingly, he brought one Ashadul Hoque who himself represented as a Holy Men [Sadhu] to her and the aforesaid Ashadul Hoque stayed for 3 days in the house of the informant and performed traditional rituals and prayers; that they introduced themselves as Hindu in front of the informant and in the hope of cure of her son, she provided sufficient amount as demanded by them; accordingly, she paid an amount of Rs. 7,50,000/- altogether to the aforesaid Ashadul Hoque; however, after spending considerable amount of money and spending sufficient time, since the son of the informant was not cured, she got suspicions and she found out that the aforesaid Ashadul Hoque and his accomplice were not from the Hindu community as they have claimed as Holy Men [Sadhu] but they belong to Muslim community. It was also alleged that during their stay, the aforesaid Ashadul Hoque and his accomplice tried to rape her. After they went off, the informant with her lot of efforts and visiting him several times, the aforesaid Ashadul Hoque and his accomplice returned Rs. 1,50,000/- to the informant and transferred an amount of Rs. 50,000/- through online. However, the remaining amount Rs. 5,50,000/- is yet to be paid by the aforesaid Ashadul Hoque and his accomplice. In view of the aforesaid FIR, the Police registered the Serfanguri Police Station Case no. 02/2026 under the afore-mentioned sections. The Police accordingly arrested the aforesaid Ashadul Hoque and Shomser Ali. During the investigation, it was found that about Rs. 2,71,000/- was transferred to the account of the accused-applicant by the aforesaid two accused persons. Page No. 3/3 4. Mr. Islam, learned counsel appearing for the accused-applicant submits that the brother-in-law of Ashadul Hoque is a neighbour and on their request, he has given his account number to them only to transfer the money and is no way linked to the alleged offence as narrated in the FIR. He submits that he will fully cooperate with the investigation and therefore, prays for anticipatory bail. 5. On the other, Mr. Goswami, learned Additional Public Prosecutor, Assam opposes the prayer that the accused-applicant is also an accomplice of the arrested accused persons and therefore, his account has been utilised by them. 6. After hearing the learned counsel appearing for the respective parties and on perusal of the materials that have been brought on record, this Court is not inclined to grant any relief to the accused-applicant at this stage.
