1. The petitioner has filed this petition seeking the following relief(s):-
“10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of petitioner. 10.2 That, the Hon’ble Court may be pleased to issue appropriate writ/direction/order directing the respondent No. 2 to release the amount with respect to difference of area of Digitally signed by RAMESH KUMAR VATTI Date: 2026.04.23 16:54:18 +0530
2 house and also be pleased to release the withheld amount within 15 days with interest @ 15% p.a. 10.3 That, the Hon’ble Court may kindly be pleased to grant any other relief including the cost of the petition, as it may deem fit and appropriate.”
2. Mr. Sanjay Patel, learned counsel appearing for respondent No. 3 would submit that the sole petitioner has died and no application has been moved for substitution of his legal representatives.
3. As there is no representation on behalf of the petitioner and no application has been moved for substitution of legal representatives, this Court is left with no other option except to dismiss the petition.
4. Accordingly, this petition is dismissed. However, the legal representatives of the petitioner would be at liberty to revive their prayer, if cause of action still survives. Sd/-
