HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 5527 of 2026 Court No. - 53 HON'BLE VIKAS BUDHWAR, J. 1. The matter has been taken up in revised list. Nobody is present on behalf of the applicant. 2. The present contempt petition has been preferred alleging non-compliance of the order dated 03.12.2024 passed in Writ-A No. 58950 of 2009, the order whereof is quoted hereinunder: "Heard learned counsel for the petitioner and Shri Sandeep Kumar Singh, learned Additional Chief Standing Counsel appearing for the respondents 1, 2 and 4. The contention of learned counsel for the petitioner is that the grand father of the petitioner, namely Shri Brij Bhushan Lal was receiving freedom fighter pension from the Union of India and on the demise of his parents, as per the scheme, he too, being grand son of the freedom fighter, is entitled to pension under that scheme as also the arrears that were payable to the deceased freedom fighter that has accrued during his life time. A counter affidavit has been filed by the respondent no.4. In paragraph 9 and 10 of which it has been stated as follows:- "9. That in reply to the contents of paragraphs 9,10, 11 and 12 of the writ petition, it is submitted that after 1991, no application has been filed regarding non-receiving of both the pension by Shri Brij Bhusan Lal to the Treasury Office, Allahabad and no application filed for obtaining any regular and balance dues of pension to the Treasury Office. The alleged application which is addressed to the District Magistrate, Allahabad was not received in he Treasury Office and the alleged application is not available in the oflice record o! Treasury as well as District Magistrate. The averments to the contrary are incorrect hence denied. That in reply to the contents of paragraph 13 of the writ petition, it is submitted that in paragraph 957 of C.S.R. Rules. it is clarified that in case pension amount has not been received for more than 6 years then the same could be paid only by the State Government on the recommendation of the Incharge Officer, Political Pension, Allahabad/District Magistrate, Allahabad and as such the pension dues from 1.12.1991 to 24.12.2004 will be payable on the approval of the competent authority/State Government." In view of the aforesaid facts and circumstances, we permit the petitioner to move a detailed application before the District Magistrate enclosing all the relevant records, which the District Magistrate shall consider in accordance with law. If any other document or other compliance is required to be done by the petitioner, the same shall be communicated to the petitioner. Thereafter, a decision/recommendation be taken/made by the District Magistrate as he may deem fit. This process is required to be completed expeditiously and preferably within a period of three months from the date of the application filed along with certified copy of this order. Subject to the above, this petition stands disposed of." 3. Today instructions have been produced annexing therewith the order dated 14.05.2025 deciding the claim of the applicant which is quoted hereinunder: "िनस्तारण आदेश श्री िवजय कु मार श्रीवास्तव, पुत्र स्व० बृजेन्द्र कु मार श्रीवास्तव, िनवासी-118 चकिनरातुल, प्रयागराज द्वारा अपने आवेदन पत्र िदनांक 14.02.2025 के साथ िरट यािचका संख्या 58950/2009 िवजय कु मार श्रीवास्तव बनाम उत्तर प्रदेश सरकार व अन्य में माननीय उच्च न्यायालय, इलाहाबाद द्वारा पािरत िनणर्य िदनांक 03.12.2024 की प्रमािणत प्रित संलग्न करते हुए अपने दादा स्व० बृजभूषण लाल िजनकी मृत्यु की ितिथ 24.12.2004 संसूिचत की गयी है, के वषर् 1991 से िदनांक 24.12.2004 तक जीवनकालीन अवशेष पेंशन का भुगतान कराये जाने हेतु अनुरोध िकया गया है। माननीय उच्च न्यायालय द्वारा िरट यािचका संख्या 58950/2009 िवजय कु मार श्रीवास्तव बनाम उत्तर प्रदेश सरकार व अन्य में िदनांक 03.12.2024 को िनम्न आदेश पािरत िकये गये है :- 10. That in reply to the contents of paragraph 13 of the writ petition, it is submitted that in paragraph 957 of C.S.R. न्यायालय के उपरोक्त आदेश के समादर में स्व० बृजभूषण लाल की पेंशन पत्रावली का पिरशीलन िकया गया। स्व० बृजभूषण लाल (स्वतंत्रता सेनानी) पी0पी0ओ0 संख्या-राजनैितक के न्द्रीय/15041 तथा राजनैितक प्रान्तीय/28697 के माध्यम से के न्द्रीय/प्रान्तीय स्वतंत्रता संग्राम सेनानी सम्मान रािश का भुगतान तत्समय प्रचिलत व्यवस्था के अन्तगर्त प्रत्येक माह कोषागार में उपिस्थत होकर नकद प्राप्त करते थे। कायार्लय में उपलब्ध दोनो भुगतानादेशों का परीक्षण करने पर पाया गया िक स्व० बृजभूषण लाल द्वारा सम्मान रािश का भुगतान प्राप्त करने हेतु अंितम बार िदनांक 01.11.1991 को कोषागार में उपिस्थत होकर िदनांक 31.10.1991 तक की दोनों सम्मान रािशयों (पेंशन) का भुगतान प्राप्त िकया गया है। इसके पश्चात स्व० बृजभूषण लाल उक्त प्रािधकार पत्रों पर पेंशन प्राप्त करने हेतु कोषागार कायार्लय में उपिस्थत नहीं हुए और न ही कोई जीिवत प्रमाण पत्र इत्यािद प्रस्तुत िकया गया। िदनांक 01.11.1991 के उपरान्त श्री बृज भूषण लाल द्वारा अपनी पेंशन के भुगतान हेतु कोई दावा भी प्रस्तुत नहीं िकया गया, िजसके कारण उन्हें उक्त दोनो प्रािधकार पत्रों पर अक्टूबर 1991 के उपरांत कोई भुगतान नही िकया गया है। उक्त के अितिरक्त यह तथ्य भी प्रकाश में आया िक स्व0 श्री बृजभूषण लाल के पक्ष में उपलब्ध पेंशन प्रािधकार पत्रों पर जीवन कालीन अवशेष भुगतान के सम्बन्ध में िकसी पािरवािरक सदस्य के पक्ष में नामांकन नहीं िकया गया है। सूच्य है िक लम्बी अविध तक अभुगतािनत पेंशन के जीवन कालीन अवशेष भुगतान के सम्बन्ध में उत्तर प्रदेश शासन, िवत्त (लेखा) अनुभाग-1, लखनऊ के वतर्मान CAPL No. 5527 of 2026 3 प्रवृत्त शासनादेश संख्या 16/2019/ए-1-1137/दस-2019-10 (23)/95, िदनांक 09.12.2019 में उल्लेख िकया गया है िक यिद िकसी पेंशनर की तीन वषर् से अिधक समय तक पेंशन का भुगतान नहीं िकया गया है तो पेंशन अवशेष के भुगतान हेतु उक्त शासनादेश िदनांक 09.12.2019 के प्रस्तर-4 में िविहत प्रिक्रया का अनुपालन िकया जायेगा। प्रस्तर-4 में यह प्रािवधान है िक "पी0पी0ओ0 िनगर्त करने वाले प्रािधकारी को उपयुर्क्तानुसार प्रेिषत पी0पी0ओ0 के पुनवेर्धीकरण के उपरान्त कोषागार में प्राप्त होने पर पेंशनर डाटा बेस में उसकी पुनः इन्ट्री कर िनधार्िरत रिजस्टर में यथास्थान प्रिविष्ट की जाये तथा पेंशन अवशेष भुगतान एवं पुनभार्हरण शुरू िकया जाये। इसकी सूचना भी िनदेशक पेंशन को अिनवायर् रूप से भेजी जाये। िजसके क्रम में कोषागार कायार्लय के पत्र संख्या 141. िदनांक 17.04.2025 के साथ पी०पी०ओ० संख्या-राजनैितक के न्द्रीय/15041 तथा राजनैितक प्रान्तीय/28697 को मूल रूप में विरष्ठ लेखािधकारी, पेंशन स्टेट, महालेखाकार, (लेखा एवं हकदारी) िद्वतीय, उ0प्र0, प्रयागराज के कायार्लय को पुनवेर्धीकरण के िलए प्रेिषत िकया गया है। पुनवेर्धीकरण के उपरान्त पेंशन प्रािधकार पत्र महालेखाकार कायार्लय से अद्यतन अप्राप्त है। राज्य राजनैितक/के न्द्रीय राजनैितक सम्मान रािश (पेंशन) के भुगतान के सम्बन्ध में अद्यतन यह व्यवस्था है िक राज्य राजनैितक सम्मान रािश (पेंशन) का भुगतान कोषागार स्तर से िकया जा रहा है तथा के न्द्रीय राजनैितक सम्मान रािश (पेंशन) का भुगतान भारत सरकार गृह मंत्रालय, नई िदल्ली के नोिटिफके शन संख्या F.55/21/2013/FFP Deted 27.06-2014 के क्रम में उत्तर प्रदेश शासन, राजनैितक पेंशन अनुभाग-2 के शासनादेश संख्याः मु0स0 23 जेड (2)/छ:- 2014-07पी0पी0/2014 िदनांक 28.07.2014 के द्वारा िसतम्बर, 2014 के अनुपालन में राष्ट्रीयकृ त बैंकों के माध्यम से िकये जाने के िनणर्य के उपरान्त के न्द्रीय पेंशन लेखा कायार्लय, भीकाजी कामा प्लेस, नई िदल्ली के द्वारा के न्द्रीय स्वतंत्रता सेनािनयों/उनके आिश्रतों को पेंशन का भुगतान उनके खाते में सीधे िकये जाने की कायर्वाही की जा रही है। अतः 01 अक्टूबर, 2014 के पश्चात राज्य राजनैितक सम्मान रािश का भुगतान ही कोषागार स्तर से िकया जा रहा है। कोषागार कायार्लय की आख्यानुसार श्रीमती सुषमा श्रीवास्तव, पुत्रवधू स्व० बृजभूषण लाल व श्री िवजय कु मार श्रीवास्तव पुत्र स्व० बृजेन्द्र कु मार श्रीवास्तव द्वारा स्व० बृजभूषण लाल राजनैितक पेंशनर की मृत्यु तथा जीवन कालीन अवशेष के सम्बन्ध में कोई प्राथर्ना पत्र कोषागार में प्राप्त नहीं हुआ है। अपर िजलािधकारी (नगर), इलाहाबाद (प्रयागराज) के पत्रांक 182/पी0पी0सी0, िदनांक 11.03.2010 में यह उल्लेख िकया गया है िक "आवेदक द्वारा जो िजलािधकारी, इलाहाबाद को सम्बोिधत प्राथर्ना पत्र संलग्न िकये गये हैं, उन पत्रों का कायार्लय में प्राप्त कराये जाने की पुिष्ट स्पष्ट नहीं है। और न ही पत्र इस कायार्लय में उपलब्ध है।" इस प्रकार कोषागार कायार्लय एवं कलेक्ट्रेट कायार्लय में याची का राजनैितक CAPL No. 5527 of 2026 4 पेंशनर की मृत्यु एवं जीवन कालीन अवशेष के भुगतान संबंधी कोई आवेदन पत्र प्राप्त होना नहीं पाया गया है। िरट यािचका के साथ संलग्न आवेदन पत्र एवं मृत्यु प्रमाण पत्र के आधार पर यह ज्ञात हुआ है िक श्री बृजभूषण लाल, स्वतंत्रता सेनानी की िदनांक 24.12.2004 को मृत्यु हो गयी है तथा जीवन कालीन अवशेष का भुगतान िकया जाना है। पेंशनर की मृत्यु की दशा में जीवन कालीन अवशेष के भुगतान हेतु पेंशन प्रपत्रों में नािमनी का नाम अंिकत न होने के कारण तथा लम्बी अविध (िदनांक 01.11.1991 से याची द्वारा संसूिचत मृत्यु की ितिथ िदनांक 24.12.2004 तक) तक पेंशन अनाहिरत रहने के कारण मुख्य कोषािधकारी, प्रयागराज कायार्लय के पत्रांक 228/पेंशन स्टेट/सी0पी0सी0/वाद/2024-25 िदनांक 25.04.2025 द्वारा उप िजलािधकारी, सदर, प्रयागराज को स्व0 बृजभूषण लाल, राजनैितक पेंशनर की मृत्यु एवं उनके वािरसों के सम्बन्ध में जाँच आख्या उपलब्ध कराये जाने हेतु पत्र प्रेिषत िकया गया है।उप िजलािधकारी, सदर, प्रयागराज की जाँच आख्या व महालेखाकार कायार्लय से पेंशन प्रािधकार पत्र के पुनवैर्धीकरण होकर प्राप्त होने पर िनयमानुसार आवश्यक कायर्वाही सुिनिश्चत करायी जायेगी। अतः उपरोक्तानुसार श्री िवजय कु मार श्रीवास्तव, पुत्र स्व0 बृजेन्द्र कु मार श्रीवास्तव, िनवासी-118 चकिनरातुल, प्रयागराज द्वारा प्रस्तुत प्रत्यावेदन िदनांक 14.02.2025 िनस्तािरत िकया जाता है।" 4. The said fact has not been disputed by the learned counsel for the applicant. Let a copy of the instructions be served upon the learned counsel for the applicant. 5. Accordingly, the contempt application stands consigned to record, leaving it open for the applicant to question the said order before appropriate forum in accordance with law. 6.
