JUSTICE V SRISHANANDA ORAL ORDER After addressing the arguments, learned counsel for the petitioner files a memo which reads as under. “The Petitioner herewith submits as follows: 01. That the Hon'ble First Appellate Court has allowed in part, the Petitioner has convicted and sentenced to pay fine of Rs.3,60,000-00 and out of fine amount a sum of Rs.3,50,000-00 is ordered to be paid as compensation to the Respondent and remaining Rs.10,000-00 shall be appropriated to the Government. As the Petitioner is ready to pay the amount of Rs.3,50,000-00 under 6 monthly installments as hereunder: 01. The Petitioner has made deposit 50% of fine amount before the Trail Court in compliance of interim order passed by the First Appellate Court and this Hon'ble Court. 02. The Petitioner herewith undertakes to reaming 50% of Rs.3,50,000/-i.e. Rs.1,75,000-00 under six monthly equal installments of Rs.29,166/-to be payable on or before 10th of every subsequent month from April to - 3 - HC-KAR NC: 2026:KHC:15261 CRL.RP No. 69 of 2018 September 2026(last installment of Rs.24,166.00) and pray for waiver of Rs.10,000-00 as fine to Government. 03. The Petitioner have no objection to Respondent to withdraw the amount made deposit before the Trial Court. Hence this Memo. “ 2. Placing the memo on record, petition stands disposed of. 3. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 4. Balance compensation amount as per the memo is to be deposited before the Trial Court regularly.
