WPMS No. 3737 OF 2025 With WPMS No. 3738 of 2025 WPMS No. 3739 of 2025 WPMS No. 3745 of 2025 WPMS No. 3749 of 2025 WPMS No. 3794 of 2025 WPMS No. 3801 of 2025 WPMS No. 29 of 2026 WPMS No. 31 of 2026 WPMS no. 34 of 2026 Hon’ble Manoj Kumar Tiwari, J
1. Mr. Atul Kumar Bansal & Mr. Harshpal Sekhon, Advocates for the petitioners.
2. Mr. Suyash Pant, learned Standing Counsel for the State of Uttarakhand.
3. Since common questions of fact and law are involved in these petitions, therefore, these petitions are clubbed together and decided by this common
judgment. However, for the sake of brevity and convenience, facts of WPMS No. 3737 of 2025 alone are being considered and discussed.
4.
Learned counsel for the petitioners submits that similar issue was dealt with by this Court in WPMS No. 3367 of 2025; he, therefore, submits that the writ petition deserves to be decided in terms of the order dated 16.12.2025 passed in the said writ petition along with connected matters.
5. Learned State Counsel concedes that issue involved is identical, therefore, he has no objection, if the writ petition is decided in terms of the order dated 16.12.2025 rendered in WPMS No. 3367
2026:UHC:207 of 2025 & other connected matters.
6. The writ petitions are, accordingly, decided in terms of
order dated 16.12.2025 rendered in WPMS No. 3367 of 2025 & other connected matters. The petitioners shall be at liberty to make separate application(s) to District Magistrate concerned, for correcting the provision invoked for allotting land to them. If such representation(s) is made within two weeks from today, District Magistrate shall examine the matter and pass appropriate order, within eight weeks thereafter. Stake holders, if any, shall also be heard while taking any decision in the matter.
