DATED : 15.09.2026 My attention has been drawn to order of this Court dated 08.04.2022, which for the sake of brevity, is reproduced under : “1] Heard learned counsel for the petitioner. 2] The learned counsel for the petitioner makes a statement that the petitioner is ready to furnish security in the form of solvent surety in the sum of Rs.35 lacs before the Trial Court before 30.04.2022. Statement is accepted. 3] In the mean time, there shall be stay to the impugned order dated 07.12.2021. 4] High Court Legal Service Sub Committee, Nagpur is requested to appoint counsel for respondent from the panel, as according to the learned counsel for the petitioner, the respondent is in jail. It is the submission of Mr. Deo, learned Counsel appearing for the petitioner, that the order has been complied with and a solvent surety to the tune of Rs.35,00,000/- is deposited before the Trial Court. He also submits that since there was no stay to the proceedings, the trial has proceeded substantially and the evidence has been recorded. On the other hand, Mr. R.P. Meshram, learned Advocate informs the Court that Mr. D.V.. Chauhan, learned Government Pleader was appointed through Legal Aid, however, at present, he is a Government Pleader in this Court and therefore would not be able to appear in the matter. 3. Be that as it may, without adverting to the merits of the matter, the writ petition is disposed of by making the order dated 08.04.2022, as reproduced supra, to be operational till the pendency of the suit, bearing Special Civil Suit No. 914 of 2022 (which was earlier old suit bearing Summary Civil Suit No. 249 of 2019). 4.
