Petitioner has filed the present writ petition seeking minimum of pay scale on the post of X-Ray Technician with the respondent no.3-Medical Department. 2. The petitioner is working as Class IVth Employee with the respondent-Department since 03.02.2010; thereafter the petitioner is working as X-Ray Technician w.e.f., 12.06.2024 and subsequently w.e.f., 30.06.2020, the petitioner is discharging the duties of Radiography Technician. 3. Learned counsel for the petitioner submits that he has discharged his duties on the post of Radiography Technician for the last 6 years therefore he is claiming minimum of pay scale of the Radiography Technician in the Hospital. 4. Learned counsel for the respondent no.2 submits that the writ of mandamus is not maintainable as the petitioner has not filed any representation before the respondent-Authorities for a grant of minimum pay scale, therefore no order can be passed in the writ petition; however in the interest of justice a liberty can be granted to 1 UKHC010133212026 2026:UHC:6709 the petitioner to move a representation to respondent no.3. 5. Accordingly writ petition stand disposed of with a direction to respondent no.3 within a period of two weeks’ from today and if such a representation is moved by the petitioner ventilating his grievance regarding the grant of minimum of pay scale the respondent no.3 shall consider the same sympathetically within a period of eight weeks’ from the date of its receipt of such representation, in accordance with law.
