Sundar, CJ) 09.09.2026 [1] After some arguments, Mr. Tungrei Ngakang, learned counsel on record for the writ appellants sought leave of this Court to withdraw the captioned Writ Appeal (WA) and the captioned Miscellaneous Case (MC) thereat and learned counsel made a further plea to preserve all rights and contentions of the WA appellants/MC applicants to move a suitable MC before Hon’ble Single Bench in the pending writ petition being WP(C) No. 543 of 2026. To be noted, suitable MC will include an MC seeking interim stay of impugned order dated 02.06.2026 appointing R4 {fourth respondent i.e., Shri. Ramnganing Horam as Chairman of MGNREGS qua Sihai Khunou village which has been assailed in the main WP (Writ Petition)}. [2] As regards the afore-referred request of Mr. Tungrei Ngakang, learned counsel on record for writ appellants/MC applicants, learned counsel on record has made endorsements in the case file and scanned reproduction of the endorsements made in the captioned WA and captioned MC thereat are as follows : [3] Before concluding, though obvious, we make it clear that if the appellants/MC applicants in captioned WA/MC file a fresh MC in the pending writ petition i.e., WP(C) No. 543 of 2026, Hon’ble Single Bench will consider the same on its own merits and in accordance with law untrammeled by instant withdrawal order. [4] In the light of the narration thus far, captioned WA and captioned MC thereat are disposed of as withdrawn/closed albeit with preservation of rights and contentions and observations as above.
