By the present application, non-applicant No.1-claimant seeks transfer of the entire amount of compensation deposited by the appellant- Insurance Company before this Court, on the ground that the appeal preferred by the appellant has been dismissed for want of prosecution. Therefore, the amount deposited by the appellant before this Court is required to be transferred to the learned Motor Accident Claims Tribunal, Yavatmal, for disbursement. 02. Needless to say, the appellant-Insurance Company had filed First Appeal No.1230/2013, challenging the judgment and award passed in C.P. No.351/2004. While filing the appeal, the Insurance Company had deposited the statutory amount. However, the appeal came to be dismissed for want of prosecution for non-compliance with the order dated 31/07/2017. Therefore, the amount of compensation deposited by the appellant-Insurance Company needs to be transferred to the learned Motor Accident Claims Tribunal, Yavatmal. 03. Accordingly, the Registry of this Court shall transmit the entire amount of compensation deposited by the appellant-Insurance 2026:BHC-NAG:12223 908.caf.3620.26 2/2 Company, along with accrued interest, to the learned Motor Accident Claims Tribunal, Yavatmal, for disbursement of the amount in accordance with the judgment and award dated 24/09/2010 passed in C.P.
