…………Petitioner Vs. Union of India and another ……….Respondents
Hon’ble Pankaj Purohit, J.
Mr. Vinay Kumar and Mr. Tajhar Qayyum, learned counsel for the petitioner.
2. Mr. Bhupendra Prasad, learned counsel holding brief of Mr. Syed Nadim, learned counsel for the respondents.
3. The present writ petition has been filed by the petitioner seeking a writ of mandamus to respondent to consider his candidature for compassionate appointment as per the claim applicable in Kendriya Vidyalaya Sangathan.
4.
Learned counsel for the respondent raised a preliminary objection that the writ petition is not maintainable before this Court as the same would be cognizable by the Central Administrative Tribunal under Administrative Tribunals Act, 1985.
5. The objection raised by learned counsel for the respondents is correct and the same is also not disputed by
learned counsel for the petitioner.
6. In such view of the matter, the writ petition stands
disposed of with a liberty to the petitioner to file a petition/application before the Central Administrative Tribunal.
