For Petitioner(s): J.Lakshminarayanan P.Mohanraj P.Manojkumar V.Jothi Shankar https://www.mhc.tn.gov.in/judis WP No. 12848 of 2026 __________ Page2 of 4 For Respondent(s): M/s.S.Pavithra, Standing counsel ORDER M/s.S.Pavithra, learned Standing counsel accepts notice on behalf of the respondents. 2.With the consent of the learned counsels on either side, the writ petition is taken up for final disposal. 3.The petitioner has filed the present writ petition for a mandamus to direct the respondents to revise the petitioner’s wages with effect 01.09.2019 based on the 14th wage settlement dated 24.08.2022 and pay him the arrears of wage payable from 01.09.2019 to 31.03.2020, difference in Leave Salary and Gratuity along with the interest at the rate of 12 percentage per annum from the date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Court. 4.The case of the petitioner is that he retired from the service of the Tamil Nadu State Transport Corporation as Senior Tradesman on 31.03.2020, on attaining the age of superannuation. It is the grievance of the petitioner that the respondents have not settled the revised/terminal benefits such as difference in Leave Salary and Gratuity and the interest for the belated payment, to the petitioner. The petitioner had also submitted a representation on 14.02.2026 to the respondents, seeking the aforesaid relief, but the same has not been considered by the respondents till date. Hence, the writ petition. https://www.mhc.tn.gov.in/judis WP No. 12848 of 2026 __________ Page3 of 4 5.The learned Standing counsel for the respondents fairly conceded that the petitioner is entitled to revised pay as per the terms of 14th Wage Settlement, dated 24.08.2022, and that they are willing to pay the arrears of wage payable from 01.09.2019 to 31.03.2020, difference in Leave Salary and Gratuity, with interest at the rate of 6% per annum for the belated payment on the eligible and admissible amount to the petitioner. 6.Heard the rival submissions and perused the records. 7.In view of the above submission of the learned Standing counsel for the respondents, this Court deems it appropriate to direct the respondents to pay the eligible and admissible amount with interest at the rate of 6% per annum for the belated payment of the arrears of wage payable from 01.09.2019 to 31.30.2020, difference in Leave Salary and Gratuity, to the petitioner within a period of twelve weeks from the date of receipt of a copy of this order. 8.With the above direction, the writ petition stands disposed of.
