Learned counsel for the petitioner submits that the petitioner is in custody since 22.03.2025 in connection with S.T. No. 221 of 2025 arising out of Kunda P.S. Case No. 45 of 2025 corresponding to G.R. Case No. 619 of 2025, registered under Sections 103(1), 61(2)(a) and 3(5) of the Bharatiya Nyaya Sanhita, now pending in the court of learned Principal District Judge, Deoghar. 3. Learned counsel for the petitioner has further submitted that admittedly there is land dispute between the informant party and the accused and though the petitioner is named in the First Information Report and was provoked to assault the victim, but there is no allegation that he acted as per the provocation. 4. Learned counsel for the petitioner also submits that the co- accused persons namely, Rajendra Pandey and Dablu Pandey @ Dablu Kumar Pandey have been enlarged on bail vide common order dated 07.01.2026 passed in B.A. No. 8205 of 2025 and B.A. No. 8596 of 2025. 5. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that all the accused persons joined together for the purpose of assault and ultimately, the victim died of head injury. 6. After hearing the learned counsel for the parties and considering the submissions and the fact that similarly situated co- 2026:JHHC:6975 2 accused persons have been enlarged on bail by a co-ordinate Bench of this Court, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Principal District Judge, Deoghar in connection with S.T. No. 221 of 2025 arising out of Kunda P.S. Case No. 45 of 2025 corresponding to G.R. Case No. 619 of 2025, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. (vi) The petitioner shall not disturb the informant party in any manner. 7.
