The present writ petition has been filed seeking a direction to respondent/MCD to take appropriate action in respect of unauthorised construction being carried out at the property bearing Municipal No. 10429- 10432, situated at Gali Pathshala Wali, Manak Pura, Karol Bagh, New Delhi-110005. 2. Counsel appearing for private respondent submits that the easement right of the petitioner is not being affected by the ongoing construction as there is another house between the petitioner’s property and the subject construction. He further submits that the petitioner is a habitual litigant who has filed various petitions against construction in the area. 4. Mr. Ashutosh Gupta, appearing on behalf of the MCD, submits that the building is being constructed as per sanction plan. Once the building is being constructed, in the event there is any deviation, the respondent/MCD shall take appropriate action in accordance with law. He confirms that the sanction plan is in respect of a residential building alone. 4.1 MCD shall remain bound by the aforesaid statement. 5.
