Rai Ms. Sofia Nesar Mr. Santanu Sett …for the Petitioner In this application, the petitioner/complainant has made a prayer for a direction upon the court below for expeditious disposal of the proceeding being G.R. case no. 768 of 2019. It is submitted on behalf of the petitioner that in this case, the charge-sheet dated 30th June, 2021, was placed on record by the court below on 7th August, 2021, when the Trial Court issued warrant of arrest against all the seven charge- sheeted accused persons. Since then for the last five years, the case is posted under the heading “Execution report of warrant of arrest”. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the State/opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party/State is hereby dispensed with. In view of the aforesaid facts and circumstances of this case, it appears that the prayer made by the petitioner is 2 justified in view of the stereotype order passed by the Trial Court for the last six years, the instant application being CRR 660 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious hearing of the proceeding and in order to secure the attendance of the accused persons for the charge hearing, the court below is directed to take immediate steps under Section 82 and 83 of the Code of Criminal Procedure.
