[2026:RJ-JP:24528] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 8424/2026 URN: CRLMB / 15349U / 2026 Vikas Urf Kalu Son Of Amar Singh, Aged About 29 Years, Resident Of Bissa Tan Nalpur, Police Station Mehada, District Jhunjhunu (Raj.) ( At Present In Cenrtral Jail Bikaner) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Vijayant Nirwan For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 02/07/2026 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.128/2025 registered at Police Station Mehada, District Jhunjhunu for offence under Sections 189(2), 115(2), 126(2), 331(6), 109(1), 324(4) and 324(5) of BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that, though there is an allegation that the petitioner caused a life- threatening injury to the injured, there is no specific overt act or injury attributed to him. It is submitted that the medical evidence does not specifically indicate that any life-threatening injury was caused to the injured. It is further submitted that the co-accused, Ramchandra, has already been enlarged on bail by a Coordinate Bench of this Hon'ble Court vide order dated 10.09.2025, and [2026:RJ-JP:24528] (2 of 2) [CRLMB-8424/2026] another co-accused, Deepak, has also been enlarged on bail by a Coordinate Bench vide order dated 25.08.2025. The remaining three co-accused have been granted bail by the learned trial Court. The petitioner has been in judicial custody since 16.04.2026. Though the petitioner has ten criminal antecedents, it is submitted that he has been granted bail in all those cases. Charge-sheet has been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Vikas Urf Kalu Son Of Amar Singh, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
