This application has been preferred by the petitioner for cancellation of anticipatory bail granted to the opposite party nos. 2 and 3 vide order dated 14.10.2020 passed in A.B.A. No. 4028 of 2020. The reason which has been put forward by the learned counsel for the petitioner for cancellation of bail is with respect to the non-deposit of separate drafts of Rs. 4,00,000/- and Rs. 17,00,000/- as undertaken by the opposite party nos. 2 and 3. It appears that the opposite party nos. 2 and 3 were granted anticipatory bail by this Court on 14.10.2020 in A.B.A. No. 4028 of 2020 and the relevant part of the order reads as under: “On consideration of the undertaking given by the learned counsel for the petitioners, I am inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, the petitioners, above named, are directed to surrender in the court below within a period of eight weeks from today along with separate drafts of Rs.4,00,000/- by the petitioner no. 1 and Rs. Neutral Citation No. ( 2026:JHHC:1750 ) 17,00,000/- by the petitioner no. 2, drawn in favour of the complainant and if the petitioners adhere to the undertaking given as indicated above in that event, they will be enlarged on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Ranchi, in connection with Complaint Case No. 1106 of 2018, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.” Since the deposit of the drafts as noted in the said order is a precondition to the grant of anticipatory bail and since according to the learned counsel for the petitioner the opposite party nos. 2 and 3 have not surrendered before the learned trial court, the same has rendered the order dated 14.10.2020 passed in A.B.A. No. 4028 of 2020 as redundant and consequent to the same, this application stands disposed of.
