The petitioner has filed the present writ application challenging the notice dated September 21, 2019 wherein the petitioner is directed to remove the unauthorized cycle garage/stall immediately failing which the authorities will take appropriate steps in accordance with law. The petitioner submits that as per the notice, the petitioner has been evicted by the respondents/authorities from the premises-in-question. The only grievance of the petitioner that the petitioner is a Scheduled Tribe and he is entitled to have the possession of the premises-in-question, the authorities have illegally evicted the petitioner from he said premises. 2. Learned counsel for the petitioner further submits that the authorities have accepted the rent of the premises-in- question but in spite of the same the authorities have issued a notice of the petitioner and evicted the petitioner. 3. Learned counsel for the respondents submits that even after the issuance of the notice, the petitioner failed to 2 vacate the premises and accordingly, the respondents/authorities evicted the petitioner in accordance with law. 4. The petitioner has not challenged the eviction proceeding only the notice has been challenged but the notice has become infructuous and the petitioner has already been evicted from the premises-in-question. 5. Considering the above, this Court finds that there is nothing remains in the present writ application. The petitioner has already been evicted from the premises in the year 2019. 6. Thus the writ petition is dismissed. 7. However, there shall be no order as to costs. 8. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities. (Krishna Rao, J.)
