Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- “(i) That, this Hon'ble Court may kindly be pleased to quash the impugned oder dated 01.10.2020 (Annexure P-1) and petitioner may be allowed to operate the bus on the basis of varied time table (Annexure P-2) without insisting on counter signature till the final decision of the petition, in the interest of justice. (ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted. 2 2. Learned counsel appearing for the petitioner would submit that the petitioner - M/s. New Jeewan Bus Services is a holder of a regular Bus permit No. 549/BTR/2025 on route Bailadila to Kawardha via- Dantewada, Gidam, Jagdalpur, Kondagaon, Kanker, Raipur and back one single trip daily for the period of five years. The petitioner has filed an application for grant of variation of time table in the aforesaid regular permit held by the petitioner before the Regional Transport Authority, Bastar, Chhattisgarh (for short, “RTA, Bastar”), which was rejected by RTA, Bastar vide order dated 04.02.2019. Being aggrieved by the refusal to grant variation of time table, the petitioner had filed an appeal before the before State Transport Appellate Tribunal, Chhattisgarh (for short, STAT, Chhattisgarh), which was allowed and the matter was remanded back to the RTA, Bastar. Thereafter, varied time table has been issued in favour of the petitioner with the condition that it will be valid only after it is duly countersigned by the RTO of the other districts in which the said vehicle will ply. Following this, the petitioner has filed an application for counter signature of variation of time table issued by RTA, Bastar, which was rejected by RTA, Chhattisgarh- Raipur vide impugned order dated 01.10.2020. 3. Learned counsel appearing for the petitioner further submits that vide Gazette Notification dated 24.12.2019 (Annexure P-4), Motor Vehicles Act, 1988 (MV Act, 1988) has been amended by the State Government and the entire State of Chhattisgarh has been declared as a single region; consequently, the counter-signature of the RTO of different districts is not required. It is next contended that the petitioner wish to file fresh application for grant of variation of time table in the aforesaid regular permit before the Competent Authority, hence, this petition may be disposed of granting liberty in favour of the petitioner to file aforesaid application within a period of 15 days from today. It is also prayed that the interim protection granted by this Court in favor of the petitioner on 09.12.2021 may be directed to continue for a period of 15 days from today. 3 4. Counsel for the State has no objection to allow the limited period made by counsel for the petitioner. 5. Heard counsel for the parties and perused the material available on record. 6. Having considered the limited prayer made by counsel for the petitioner, without entering into the merits of the case, this petition is disposed of granting liberty in favour of the petitioner to file appropriate application before RTAChhattisgarh for redressal of his grievances within a period of 15 days from today, thereafter, RTA, Chhattisgarh is directed to decide the same within a further period of 30 days from the date of filing of application by the petitioner. 7. It is observed that interim protection granted to the petitioner by this Court vide order dated 09.12.2021 shall remain in force for a period of 15 days from today. 8. It is made clear that if such application is not filed within the stipulated period, then the interim protection granted by this Court vide order dated 09.12.2021 in favour of the petitioner shall lose its efficacy. 9. With the aforesaid observations & direction, the writ petition is disposed of. 10. Pending interlocutory application (s), if any, also stands disposed of.
