Mr. Soumen Kumar Dutta Mr. Subham Dutta ……For the Petitioner Mr. Tushar Sinha Mahapatra ….For the State It is the grievance of the petitioner that respondent no. 7 is carrying out unauthorized construction on Plot No. 209, J.L. No. 50, Khatian No. 478, Mouza–Satupur, Police Station– Bhagwanpur, District–Purba Medinipur. The petitioner alleges that respondent no. 7 has encroached upon a portion of the said land and is raising construction thereon without obtaining any permission from the Panchayat authorities. Learned Advocate appearing for the State has drawn the attention of this Court to page 31 of the writ petition to contend that, upon receipt of a complaint from the petitioner, the Pradhan issued notices to both the petitioner and respondent no. 7, fixing a hearing on July 2, 2025. It is, however, alleged that no further steps have been taken by the Panchayat Pradhan thereafter. The petitioner thereafter made a further representation before the Pradhan on December 8, 2025, seeking demolition of the alleged unauthorized construction. Despite service of notice, respondent no. 7 remains unrepresented. In view of the aforesaid, the writ petition is disposed of with a direction upon the Pradhan, Bhagwanpur Gram Panchayat, respondent no. 5, to conclude the proceedings and take appropriate steps in accordance with Section 23(5) of the West Bengal Panchayat Act, 1973, preferably within a period of two weeks from the date of communication of this order.
