The petitioner named above has been made accused in connection with Borio P.S. Case No. 61 of 2021 for the offence registered under Sections 147, 148, 149, 323, 325, 341, 353, 307, 332, 333, 411, 427, 379, 224, 225 and 120(B) of the Indian Penal Code, pending in the court of Judicial Magistrate-1st Class, Sahibganj. As per the F.I.R the matter involves forcibly rescuing the arrested persons namely, Surya Narayan Hansda @ Surya Hansda, by 14 named and 300 unidentified members of unlawful assembly from the police party. It is submitted by learned counsel for the petitioner that the main accused namely, Surya Narayan Hansda @ Surya Hansda, has already been granted bail by the Co-ordinate Bench of this Court and other named accused persons have also been granted bail. The petitioner’s case stands on similar footing to accused Iser Hembrom @ Iswar Hembrom and Sunil @ Gobar Maria @ Gowardhan Lohra, who have been granted bail. Learned counsel for the State has opposed the prayer for bail. Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
