The writ application has been preferred being aggrieved by the conduct of the respondent/Howrah Municipal Corporation who is carrying on demolition in the premises as per direction of the High Court, Vide order dated 02.01.2024 in WPA 55 of 2024. 3. It is submitted by the learned counsel for the petitioner that his portion is being demolished illegally without proper identification. 4. Learned counsel appearing for the Howrah Municipal Corporation submits that considering the grievance of the petitioner, the Howrah Municipal Corporation can conduct an inspection under Section 177 of the Howrah Municipal Corporation Act, 1980 and on proper identification they shall then proceed with the demolition in accordance with law. 5. Considering the said submissions, the writ application is disposed of with the direction that Howrah Municipal Corporation shall proceed as per Section 177 of the Howrah Municipal Corporation Act, 1980 within 15 days from the date of this order and till the inspection and identification is complete, the Howrah Municipal Corporation shall not carry out any demolition. 6. It is clarified that on completion of inspection and identification, the Howrah Municipal Corporation shall be at liberty to proceed in accordance with law including the demolition of the unauthorized construction/portion as per the inspection report. 7. The writ application stands disposed of. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on urgent basis after completion of all necessary formalities.
